Application for Plant Breeder’s Right

To apply for a plant breeder’s right in France applicant must establish and send to INOV a file which includes 3 different compulsory forms :

• Administrative information (form n°1A);
• Technical questionnaire, including data to distinguish the applied variety from variety whose existence is a matter of common knowledge (form n°1B);
• Novelty declaration signed by the applicant that, to the best of his knowledge, the variety is new (form n°1C).

These forms can be obtained contacting INOV.

Examination of an application and granting of the title require fee payment by the applicant (application fee, examination fee, granting fee, annual fee…). The above-mentioned fee table is determined both by the Ministry of Agriculture and the Ministry of Finance, and is available at INOV secretary.
